legal
terms
This is a translation for convenience. The Dutch version is legally binding: read the voorwaarden in Dutch.
The agreements, without the small print.
These are the terms under which you use fikst. We wrote them to be read, not to put you off. If there is anything in them you do not understand, that is our fault and we will explain it.
Last updated: 10 October 2026
- 01 Who we are
- These terms belong to Fikst, registered with the Dutch Chamber of Commerce (KvK) under number 42067065, VAT number NL232735803B01. Where these terms say "we" or "us", we mean Fikst. You can reach us at info@fikst.app or 06 48 95 91 15.
- 02 What you purchase
- You purchase two things, and they are separate from each other. The subscription gives you access to fikst. for as long as it runs. The implementation is one-off: setting up the system for the way you work, transferring your data and bringing your team along. What exactly the implementation covers is set out in the quote you receive in advance.
- 03 Right of use, not ownership
- fikst. is a product and remains ours. You receive a right of use for as long as your subscription runs. What is and remains yours: all your data, and the way the system has been set up for you, such as your types of work, your checklists, your pricing agreements and your templates. If, at your request, we build something that then becomes available to all customers, we tell you so in advance.
- 04 What it costs
- The subscription is charged per office user per month, excluding VAT. You pay nothing for technicians who only work in the field. The pricing page gives an indication; the price that applies to you is in your quote, and the quote prevails. The implementation is a one-off amount that you see on the quote in advance.
- 05 Invoicing and payment
- We invoice the implementation in one go at the start. After go-live you use fikst. free of charge for one month, without a subscription running. If you continue after that, the subscription starts and from then on we invoice monthly in advance, with a payment term of fourteen days. If you do not continue, no subscription starts and the same applies to your data as when you cancel. If you do not pay, we first send a reminder; only after that can we suspend access, and never without you having been notified of it in advance.
- 06 Price changes
- We can adjust the rates, but not without reason and not quietly. We announce a change at least two months in advance. If you do not agree with it, you may cancel with effect from the date on which the new price takes effect, at no cost.
- 07 Availability and maintenance
- We do everything we can to keep the system running, but we do not promise a percentage that we cannot deliver today. We announce planned maintenance in advance and carry it out outside office hours. In the event of an outage, we report what is going on and where things stand, rather than leaving you to guess.
- 08 Errors and support
- If there is an error in the system, we fix it at no cost. Support runs through the channels on the contact page, and you speak to someone who knows the system. What we cannot do: guarantee that every wish will be built in. What we do: tell you honestly whether something is coming and when, or that it is not coming.
- 09 Liability
- Our liability is limited to the amount you paid us in the twelve months preceding the event. We are not liable for consequential damage, lost revenue or missed jobs. This limitation does not apply in the event of intent or deliberate recklessness on our part.
- 10 F-gases and other legal obligations
- This is the most important agreement for your trade, so we spell it out. fikst. helps you keep your F-gas records: the equipment register, the recording on the work order and the report you take from it. The legal obligation itself remains yours. You are responsible for the accuracy of what is entered, for the certification of your technicians and your company, and for carrying out the mandatory checks on time. A system that thinks along is not a certificate, and we do not act as your certification body.
- 11 Your data
- Your data remains yours. We do not sell it, we do not use it for purposes other than providing the service, and we do not look at it without cause or without you knowing. We process personal data in accordance with the data processing agreement, which forms part of these terms and is equally binding.
- 12 Cancelling and leaving
- The subscription can be cancelled monthly, with effect from the end of the current month. You pay the implementation once and it is not refunded on cancellation, not even in part. If you cancel, you receive your data in a usable, machine-readable format. We then keep it for another thirty days in case you forgot something, and delete it permanently after that.
- 13 Changes to the system
- fikst. changes, because it is being built continuously. New parts are added without you paying more within your subscription. If we remove something you rely on, we tell you at least three months in advance, so that you have time to arrange something else.
- 14 Changes to these terms
- If we amend these terms, we let you know at least one month in advance. If the change is to your disadvantage, you may cancel with effect from the date it takes effect. The version on the Dutch page is always the one that applies.
- 15 Governing law
- These terms are governed by Dutch law. If we cannot resolve something together, we submit the dispute to the competent court in the Netherlands. But we would rather call first.
the data processing agreement forms part of these terms; you receive it on request. questions about these terms? ask them through the contact page.
